Kevin is a member of the firm whose practice includes a wide variety of business litigation including legal malpractice, construction and lender liability litigation.   Additionally, Kevin has experience in representing real estate developers in urban infill projects as well as experience representing small companies in general corporate matters.  Active in the community, Kevin is currently a member of the State Bar of Michigan Judicial and Professional Ethics Committee and is the Chairperson of the Royal Oak Downtown Development Authority.

Representative Experience

Key member of trial team in arbitration involving the construction of a power plant. Discovery lasted for two years and involved more than 100 depositions and the exchange of over six million pages of documents. The arbitration included 72 full hearing days, 44 witnesses and over 10,000 exhibits. Successfully argued numerous motions and performed direct and cross examinations of key witnesses during the hearings. At the conclusion of the hearings, the arbitration panel awarded BSDD's client over $25.5 million and denied nearly all of our opponent's claims.

Assisted in representation of municipality in dispute involving the construction of a $54 million detention basin. Drafted mediation summary, which led to a favorable settlement for BSDD's client during the mediation process.

Assisted in successful representation of Tier 1 automotive supplier in lawsuit arising from failed business acquisition. Drafted successful case evaluation summary which lead to seven-figure recovery for BSDD's client.

Successfully argued summary disposition and subsequent appeal on behalf of major OEM in breach of warranty action.

Investigated potential criminal RICO/antitrust matter on behalf of major automotive OEM, drafted and filed civil complaint and then negotiated six-figure settlement early in the litigation on behalf of BSDD's client.

Drafted successful summary disposition motion on behalf of major Detroit-based law firm in legal malpractice action. 

Lead trial counsel in pro bono civil rights case in the Eastern District of Michigan.

Deposed key witnesses and drafted summary disposition motion in lender liability litigation on behalf of major bank. After motion for summary disposition was filed, plaintiff voluntarily dismissed its complaint with prejudice.
