Insurance CoverageOur litigation attorneys have represented policyholders and insurance companies in disputes over the available coverage under a variety of insurance policies, including:
- Commercial general liability policies
- Directors' and officers' liability insurance policies
- Property insurance policies
- Life insurance policies
- Business interruption insurance policies
- Disability policies
- Auto policies
We also provide advice and counsel to insurance companies before litigation, helping to analyze the language of the policy, possible defenses, and limitations of liability.
For example, on the defense side, we represented Michigan's largest no-fault insurer in a series of class action lawsuits concerning its obligations under the no-fault insurance statute. As the insurer's defense counsel, we responded to separate class action lawsuits that were filed in different courts on behalf of Michigan hospitals, physicians, other health care providers, and no-fault policyholders, seeking hundreds of millions of dollars in damages and declaratory relief. In each case, we convinced the courts to deny class certification and successfully defended those decisions that were appealed.
We have also effectively advocated for individuals and businesses that have been wrongfully denied coverage. For example, we obtained a million-dollar federal court judgment on an insurance claim where the insurance company had offered just $6,000 in coverage.
